Summary

Multiple strides have been made during the last few decades to begin to assure that children with disabilities have the same educational opportunities that are available to those without disabilities. This chapter discusses some of the laws that protect the rights children with disabilities have in their educational pursuits. Some of these laws include the Individuals with Disabilities Educational Act (IDEA) (2004); the No Child Left Behind Act of 2001 (NCLB); and the American with Disabilities Act of 1990 (ADA). The chapter focuses on the successes and continuing challenges that these laws have addressed as well as what still must be addressed to truly ensure that all children receive at all grade levels the highest quality of education that can be provided in the United States. Ethical issues in caring for children with disabilities and laws affecting the education of disabled children and the healthcare system are also discussed.
