Extending the Golden Thread? Criminalisation and the Presumption of Innocence

  • This article represents part of a larger attempt to understand the scope and grounds of the presumption of innocence, which in turn forms part of the AHRC-funded Preventive Justice project, which I have worked on with Andrew Ashworth and Lucia Zedner. I am grateful to the AHRC for funding the project, and to Andrew and Lucia for help, guidance, and support, as well as for comments on multiple drafts of this article. I have also benefitted from questions and comments from Doug Husak, Nicola Lacey, Adam Swift, Victor Tadros, the editor and referees of the Journal of Political Philosophy, audiences in Oxford (twice), Stirling, and Reading, and from discussions with Christian Barry and Antony Duff.
